NOTICE TO DEFENDANTS:

If you or your attorney do not file a written answer with the clerk who issued this citation by 10:00 a.m. on the Monday next following the expiration of forty-two (42) days after the date of issuance of this citation and petition, a default judgment may be taken against you.”
TO: NELLIE SUE PHIPPS JOHNSON and HER HEIRS, KNOWN OR UNKNOWN, IF ANY SAID PERSONS ARE DECEASED, Defendants in the cause herein described.
You and each of you are hereby commanded to appear and answer before the 267TH Judicial District Court in the Jackson County Courthouse in Jackson County, Texas, at or before 10:00 a.m. on the first Monday after the expiration of forty-two (42) days from the date of issuance hereof, being at or before 10:00 a.m. on Monday, the 17TH day of July, 2017, then and there to answer the petition of ZACHRY EXPLORATION, LLC, in Cause No. 17-5-15402, styled ZACHRY EXPLORATION, LLC vs. NELLIE SUE PHIPPS JOHNSON and HER HEIRS, KNOWN OR UNKNOWN, IF ANY SAID PERSONS ARE DECEASED, wherein the said ZACHRY EXPLORATION, LLC is Plaintiff, and the said NELLIE SUE PHIPPS JOHNSON and HER HEIRS, KNOWN OR UNKNOWN, IF ANY SAID PERSONS ARE DECEASED, as Defendants. The said petition, filed on MAY 30, 2017, discloses that the nature of said suit is as follows:
This suit is brought to have a receiver appointed under the provisions of Section 64.091(d)(3) of the Texas Civil Practice and Remedies Code for undivided mineral interests owned by the Defendant in the following described lands in Jackson County, Texas, to-wit:
Tract One: 55.10 acres of land, more or less, out of an 82.53 acre tract on the West Side of County Road 282, and being more particularly described as First Tract in that certain Deed dated March 15, 1941, from Leila Florence Whitehead Kern to Henrietta Ermentrude Whitehead Mulholland, being recorded in Volume 127, Page 149, of the Deed Records of Jackson County, Texas.
Tract Two: 59.12 acres of land, more or less, out of a 252.79 acre tract and a 29.59 acre tract on the East Side of County Road 282, and being more particularly described as Tract Number One and Tract Number Two in that certain Mineral Deed dated May 16, 1978, from Mary Louise Ackley to William L. Ackley, being recorded in Volume 568, Page 387, in the Deed Records of Jackson County, Texas.
With Tract One and Tract Two being further described on Exhibit A and Exhibit B attached hereto.
And to execute oil, gas and mineral leases thereof to the Plaintiff, and take such other action deemed necessary under the provisions of said statute.
If this citation is not served within ninety (90) days after the date of its issuance, it shall be returned unserved.
ISSUED AND GIVEN UNDER MY HAND AND THE SEAL OF SAID COURT on this the1st day of June, 2017, at Edna, Jackson County, Texas.
